OVERVIEW Welcome to The Home List. The terms “we,” “us,” and “our” refer to The Home List. The Home List operates this website and store, including the information, content, features, tools, products, and services made available through it (collectively, the “Services”). The Services are powered by Shopify, which enables us to provide our online store to you. These Terms of Service (“Terms”), together with the policies referenced in them, describe your rights and responsibilities when you use the Services. Please read them carefully because they contain important information about your legal rights, warranty disclaimers, and limitations of liability. By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy, available at https://www.shopthehomelist.com/policies/privacy-policy. If you do not agree to these Terms or the Privacy Policy, do not use or access the Services.

SECTION 1 — ACCESS AND ACCOUNT By using the Services, you represent that you are at least the age of majority in your state or province of residence. If you permit a minor dependent to use the Services through a device you own, purchase, or manage, you are responsible for that use. You may be asked to provide information such as your email address, billing information, payment information, and shipping information. You represent that the information you provide is accurate, current, and complete and that you have the right to provide it. You are responsible for maintaining the security of your account credentials and for all activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 — OUR PRODUCTS We make reasonable efforts to display our products and services accurately. Colors, dimensions, materials, finishes, and product appearance may vary from how they appear on your screen because of device settings, photography, manufacturing variations, and supplier updates. Unless required by applicable law, we do not guarantee that a product’s appearance or quality will meet every personal expectation or appear exactly as depicted on a particular screen. Product descriptions, prices, availability, and specifications may be changed at any time without notice. We may discontinue a product or limit quantities available to any person, household, geographic region, or jurisdiction. Please review the product description, images, measurements, and selected variant carefully before purchasing.

SECTION 3 — ORDERS When you submit an order, you are making an offer to purchase. The Home List may accept, decline, limit, or cancel an order for a lawful reason. An order is not accepted until we confirm acceptance and successfully process payment. Please review your order carefully before submitting it. We may be unable to change or cancel an order after it has entered processing or fulfillment. If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided with the order. Purchases are subject to our Refund Policy, available at https://www.shopthehomelist.com/policies/refund-policy. You represent that purchases are for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 — PRICES AND BILLING Prices, discounts, and promotions may change without notice. The price charged will be the price shown when the order is placed and confirmed, subject to correction of obvious errors. Unless expressly stated otherwise, displayed prices do not include taxes, shipping, handling, customs duties, or import charges. Promotions may be governed by separate terms. If promotional terms conflict with these Terms, the promotional terms control for that promotion. You agree to provide current, complete, and accurate purchase, payment, and account information. You represent that you are authorized to use the payment method provided and agree to pay all applicable charges, including shipping, handling, duties, and taxes.

SECTION 5 — SHIPPING AND DELIVERY Processing and delivery times are estimates and are not guaranteed. Delays may occur because of carrier operations, customs processing, weather, high order volume, supplier processing, address issues, or other events outside our reasonable control. Nothing in this section limits rights that cannot legally be waived. Customers are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect or incomplete address may be the customer’s responsibility where permitted by law. SECTION 6 — INTELLECTUAL PROPERTY The Services—including trademarks, branding, text, graphics, photographs, video, audio, layout, and design—are owned by or licensed to The Home List and are protected by applicable intellectual-property laws. You may use the Services only for personal, noncommercial purposes. Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, transmit, sell, or exploit content from the Services except as allowed by law. The Home List’s name, logo, product names, service names, designs, and slogans are trademarks or protected branding of The Home List or its licensors. Shopify’s name, logo, product names, service names, designs, and slogans are trademarks of Shopify. Other names and marks belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS We may provide access to tools or services offered by third parties that we do not control or monitor. These tools are provided “as is” and “as available,” without endorsement or warranties from us. Your use of optional third-party tools is at your own discretion and risk and may be subject to separate third-party terms. New features, tools, and resources added to the Services are also subject to these Terms. 

SECTION 8 — THIRD-PARTY LINKS The Services may contain links to third-party websites, applications, content, or functionality. We do not control or guarantee the accuracy, availability, security, or practices of third-party services. If you leave our Services to access a third-party site, you do so at your own risk. We are not responsible for losses arising from your use of third-party websites or your purchase or use of third-party products, services, resources, or content. Review the third party’s policies before completing a transaction. Questions or claims concerning third-party products or services should be directed to that third party.

SECTION 9 — RELATIONSHIP WITH SHOPIFY The Home List is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and The Home List. Shopify is not the seller of our products and is not responsible for the products, order fulfillment, or customer service provided by The Home List. To the extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising directly from purchases and transactions with The Home List.

SECTION 10 — PRIVACY Personal information collected through the Services is handled in accordance with The Home List Privacy Policy at https://www.shopthehomelist.com/policies/privacy-policy. Because Shopify hosts the Services, Shopify also collects and processes certain information about your access to and use of the Services. Information submitted through the Services may be shared with Shopify and other service providers, including providers located outside the country where you reside, as necessary to operate the store, process transactions, prevent fraud, and provide services. SECTION 11 — FEEDBACK If you submit reviews, comments, ideas, suggestions, photographs, videos, or other content (“Feedback”), you grant The Home List a worldwide, perpetual, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback for lawful business purposes, including operating and promoting the Services. You represent that you own or control the rights necessary to submit the Feedback; that you have disclosed any compensation or incentive associated with it; and that the Feedback does not violate applicable law or another person’s rights. You remain responsible for the accuracy and legality of Feedback you submit. We may monitor, edit, decline, or remove Feedback that we reasonably determine is unlawful, abusive, defamatory, obscene, misleading, infringing, or otherwise violates these Terms. We are not required to keep Feedback confidential, compensate you for Feedback, or respond to it.

SECTION 12 — ERRORS, INACCURACIES, AND OMISSIONS Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We may correct errors, update information, or cancel an affected order at any time, including after an order is submitted, subject to applicable law. If we cancel an order after payment, we will issue the appropriate refund.

SECTION 13 — PROHIBITED USES You may use the Services only for lawful purposes. You may not use the Services to: • violate any applicable law or regulation; • infringe intellectual-property, privacy, publicity, or other rights; • harass, abuse, threaten, defame, discriminate against, or harm another person; • transmit false, fraudulent, or misleading information; • distribute spam, malicious code, viruses, or unauthorized solicitations; • impersonate another person or misrepresent your affiliation; • collect or track another person’s information without authorization; • scrape, copy, reproduce, sell, resell, or exploit the Services without permission; • interfere with, bypass, or circumvent security, access controls, robot-exclusion measures, or authorization features; or • engage in conduct that restricts another person’s lawful use of the Services or exposes The Home List, Shopify, or users to harm or liability. We may suspend or terminate access if we reasonably determine that these Terms have been violated.

SECTION 14 — AUTOMATED AGENTS This section applies when software or a service takes autonomous or semi-autonomous action to access or interact with the Services on behalf of a person or organization (an “Agent”). An Agent may not access or interact with the Services if we have requested that it stop or if access is prohibited by our technical controls. Agents must identify themselves accurately, must not conceal automated activity by mimicking human behavior, must not circumvent CAPTCHAs or other access controls, and must respond truthfully to prompts designed to distinguish automated activity from human activity. We may use technical measures to limit whether and how Agents access or interact with the Services.

SECTION 15 — TERMINATION We may suspend or terminate your access to all or part of the Services when reasonably necessary to protect the Services, enforce these Terms, prevent fraud or abuse, or comply with law. You remain responsible for amounts properly due before termination. Provisions that by their nature should survive termination—including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Assignment, Governing Law, and Privacy—will continue to apply.

SECTION 16 — DISCLAIMER OF WARRANTIES Information provided through the Services is for general informational purposes. We do not guarantee that all information will always be complete, accurate, current, or suitable for every purpose. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

SECTION 17 — LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, THE HOME LIST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR. THIS LIMITATION DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW. WHERE A JURISDICTION DOES NOT ALLOW A PARTICULAR LIMITATION, THAT LIMITATION APPLIES ONLY TO THE MAXIMUM EXTENT PERMITTED. 

SECTION 18 — INDEMNIFICATION To the extent permitted by law, you agree to indemnify and hold harmless The Home List, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from your material breach of these Terms, violation of law, violation of another person’s rights, or misuse of the Services. We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will not relieve your obligations unless the delay materially prejudices your defense. You agree to cooperate reasonably in the defense of the claim. 

SECTION 19 — SEVERABILITY If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the unenforceable portion will be severed. The remaining provisions will remain in effect.

SECTION 20 — WAIVER; ENTIRE AGREEMENT Our failure to enforce a provision of these Terms is not a waiver of that provision or any other right. These Terms and the policies posted on the Services constitute the entire agreement between you and The Home List concerning use of the Services and supersede prior communications and proposals concerning that use. Ambiguities will not automatically be construed against the drafting party.

SECTION 21 — ASSIGNMENT You may not transfer or assign your rights or obligations under these Terms without our prior written consent. Any attempted transfer that violates this section is void. We may transfer or assign these Terms and our rights and obligations as part of a merger, acquisition, financing, asset transfer, corporate reorganization, or similar business transaction, or as otherwise permitted by law.

SECTION 22 — GOVERNING LAW These Terms and any separate agreement through which we provide Services are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law principles. Subject to applicable consumer-protection laws, the parties consent to the jurisdiction and venue of the state and federal courts located in Georgia.

SECTION 23 — HEADINGS Section headings are provided for convenience and do not limit or otherwise affect the meaning of these Terms. 

SECTION 24 — CHANGES TO THESE TERMS You may review the current version of these Terms on this page at any time. We may update these Terms by posting a revised version on the Services. When required by law, we will provide notice of material changes. The revised Terms will become effective on the date stated in the update. Continued use of the Services after the effective date constitutes acceptance of the revised Terms to the extent permitted by law.
